NZHIA Seed Project – Seed Supply Terms & Purchaser Declaration

By purchasing or receiving industrial hemp seed for sowing through the NZHIA Seed Project, the purchaser acknowledges and agrees to the following terms and declarations.

References to “hemp” in this document are intended to mean Cannabis sativa plant material that meets the New Zealand legal definition of hemp, including the THC threshold of not more than 1% of dry weight.

 

1. Purpose of Supply

The New Zealand Hemp Industries Association (NZHIA) supplies iHemp seed for sowing:

• to support responsible industry development
• to improve access to small-scale seed supply
• to encourage industry education
• to promote best-practice cultivation across Aotearoa New Zealand

NZHIA acts solely as a distributor of seed sourced from reputable suppliers. NZHIA is not acting as an agent, legal adviser, agronomic adviser, medicinal-cannabis adviser, food-safety adviser, product-certifier or guarantor of cultivation or commercial outcomes.

Seed is supplied only for lawful purposes and on the basis that the purchaser will comply with all applicable New Zealand legislation, regulations and notification requirements.

 

2. Purchaser Responsibility

The purchaser acknowledges that industrial hemp cultivation remains their sole responsibility and that they are responsible for understanding and complying with all applicable laws, regulations, permissions and notifications.

The purchaser further acknowledges responsibility for cultivation decisions, crop management, testing decisions, storage, harvest practices, transport, food or product compliance, medicinal-cannabis supply restrictions, market compliance obligations and any dealings with Police, MPI or other regulators.

 

3. Police and MPI Notification Obligations

If the purchaser is planning to cultivate hemp and does not already have an applicable medicinal cannabis licence covering the activity, the purchaser must notify New Zealand Police and MPI before cultivating or planting hemp. Each notification is valid for one year.

Police notification must include the identity, address and contact details of the person intending to cultivate, the cultivation location including a plan or map where the address is not sufficient, and a description of the intended nature and scale of cultivation. MPI notification must include the grower’s identity, address and contact details.

NZHIA accepts no responsibility for notifications, licences, permissions or approvals that belong to the purchaser.

 

4. Pollen Drift & Industry Awareness

The purchaser acknowledges that hemp is a wind-pollinated crop and that pollen may affect neighbouring crops, outdoor medicinal cannabis operations, seed crops and neighbouring hemp growers.

The purchaser agrees to support responsible industry communication, cooperate in good faith where practical, and consider the wider impacts of hemp cultivation.

NZHIA is not responsible for pollen drift, cross-pollination, crop contamination or associated losses, except to the extent liability cannot lawfully be excluded.

 

5. THC Compliance

The purchaser acknowledges that environmental conditions, genetics, stress, pollination and cultivation practices may influence cannabinoid expression. THC compliance remains the responsibility of the grower and NZHIA does not guarantee THC compliance outcomes.

Testing requirements have been removed under the current hemp framework, but the purchaser remains responsible for ensuring that crops and plant material are hemp and comply with the applicable THC threshold and any market, contractual or regulatory requirements.

 

6. Seed Performance & Crop Outcomes

The purchaser acknowledges that crop performance, germination, yield, cannabinoid expression and market outcomes may vary depending on genetics, seed handling, storage, environment, pests, disease, pollination and cultivation practices.

Subject to any rights or remedies that cannot lawfully be excluded, NZHIA makes no guarantee regarding crop performance, germination rates, yield, cannabinoid expression, market suitability or commercial outcomes.

 

7. Information Documents

The purchaser confirms that they have been given access to NZHIA’s information documents and have had a reasonable opportunity to read them.

The purchaser understands NZHIA provides general educational information only and does not provide legal, agronomic, medical, food-safety, compliance or commercial certification.

 

8. Food, Medicinal Cannabis, Import/Export and Other Regulatory Restrictions

The purchaser acknowledges that hemp seed food products are regulated under the Food Act 2014 and associated requirements. The purchaser is responsible for obtaining independent advice before producing, selling or marketing any food, dietary supplement, natural-health product, cosmetic, therapeutic or medicinal product.

The purchaser acknowledges that all Cannabis sativa plants remain controlled drugs and that leaf, flower and other hemp plant material require a valid licence to import or export if they contain a controlled drug (THC). The current hemp changes do not authorise extraction from hemp leaf and flower or use of roots without an appropriate licence.

 

9. Privacy & Information Use

The purchaser acknowledges and agrees that NZHIA will manage personal information in accordance with the NZHIA  Seed Project Privacy Statement and the Privacy Act 2020.

Personal information will not be publicly disclosed except with consent or where required or permitted by law, and de-identified aggregated industry information may be used for industry coordination and reporting purposes.

 

10. Consumer Guarantees, Fair Trading and Non-excludable Rights

Nothing in these Seed Supply Terms & Purchaser Declaration excludes, restricts or modifies any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Contract and Commercial Law Act 2017 or any other applicable law.

If the purchaser acquires seed in trade, any contracting out of the Consumer Guarantees Act 1993 or relevant Fair Trading Act 1986 provisions applies only to the extent permitted by law and only where it is fair and reasonable.

 

11. Limitation of Liability

To the fullest extent permitted by law, and subject to clause 10 above, NZHIA shall not be liable for crop failure, pollen drift, cross-pollination, failed testing (including THC), regulatory breaches, market losses, crop contamination, commercial losses, indirect loss, consequential loss or loss arising from the purchaser’s cultivation, handling, storage, planting or use of supplied seed.

All cultivation and commercial activities remain at the purchaser’s own risk, except to the extent that risk cannot lawfully be transferred or excluded.
